Judge asks complaint against Kumar be dismissed

Court documents cite friend of accuser who was told allegation was fabricated

LANSING – Administrative Law Judge (ALJ) Robert H. Mourning asked the Board of Physical Therapy Disciplinary Subcommittee to dismiss a complaint filed against Dr. Vijay Kumar of West Branch to have his license to practice medicine suspended.

In the ‘Conclusions of Law’ section of his June 20 decision Judge Mourning wrote, ‘(I) conclude that there is a lack of credible evidence to support the allegations in the Complaint.’

Judge Mourning goes on to write, ‘Further, to cast doubts on her testimony, a classmate of hers testified that (complainant) told her that she had fabricated the complaint against (Kumar.)’

Dr. Vijay Kumar said after reading the decision:

‘I have said all along that I would be vindicated. I am hopeful that this is the beginning of the end of this unjust and unfair chapter of my life.

“I am grateful to the judge who listened to witnesses and examined all of the facts, and concluded this complaint from over three years ago should be dismissed.’
